Sharon Tyler is Deep in Mud

Democracy means people have the right to choose their elected leaders, including through the recall process.

That was the message when Benton Harbor City Commissioner Marcus Muhammad and 
his supporters held an August 18 press conference in front of the Berrien County Courthouse.    

They spoke out against Berrien County Clerk Sharon Tyler's decision to appeal a recent 
court ruling that put the recall of Benton Harbor Mayor James Hightower on the Nov. 4, 
2014 ballot.

"It's not about a candidate or a candidacy," Muhammad said shortly before the press conference.  "It's about democracy and the people's right to choose, because their voice is their choice." 

City voters will choose between the Whirlpool puppet Hightower and Commissioner Muhammad for mayor, if Tyler's appeal is unsuccessful. Tyler is appealing the decision on 
an emergency basis to the Michigan Court of Appeals. Tyler hired two of the largest Law firms in the country, Miller Canfield and Paddock and Dykema, Gossett PLLC with money from the citizens of Berrien County.  

She also requested $20,000.00 from the citizens Berrien County. 

Puppet mayor James Hightower's term ends Dec.31, 2014. Commissioner Trenton Bowen
stated, "The mayor said he was ready in May and Commissioner  Muhammad is ready, so I do not see what the hold up is.  Let the people vote."

The initial recall election scheduled for May 6 was cancelled at the request of the clerk and Whirlpool Corporation.  The puppet mayor was losing the election by a landslide, according to inside information on absentee ballot results. The clerk then filed a lawsuit against herself to stop the election.

After a one day trial, Judge John Dewane ordered that the recall election be put on the Nov. 4 ballot.  He said the county clerk's practice of throwing out both signatures, if a person signed a petition twice, violated the First Amendment.  The judge was on point.

Former Benton Harbor Mayor Wilce Cooke said Tyler initially approved the petitions so a recall election could be held. Then she questioned her own decision and so we have another mess in Berrien County.

Tyler gave the original petitions to the sheriff's dept. without a warrant, subpoena, or judge's order.  She contaminated the investigation and may have altered the dates on the petitions. Her hands are deep in mud and she's not to be trusted. 

Clerk Tyler is being recalled:

-- for filing a lawsuit against herself to stop the recall election on May 6, 2014.

-- for allowing the sheriff to remove the original recall petitions from her office without a warrant, subpoena, or judge's order.

-- for requesting $20,000.00 dollars of Berrien County citizens to appeal Judge DeWane's decision to place the recall election on the Nov. 4, 2014 ballot.

Sharon Tyler is a former State Representative in the 78th District.  She must go.  Join me in recalling Sharon Tyler.  She is another official controlled by the Whirlpool corporation.

The hearing is for approval of petition language for the recall of Berrien County Clerk, Sharon Tyler because of her actions described below.

First, Benton Harbor residents carried out a successful petition drive to recall their mayor, James Hightower.  County clerk Sharon Tyler illegally gave the signed petitions to sheriff deputy David Zizkovsky.  Deputies then went to Benton Harbor residents' homes and intimidated some into signing statements that they didn't know what they were signing.  And, Pinkney was accused by
county prosecutor Michael Sepic of changing petition dates.  (During a hearing, atty. John Anthony LaPietra told the court that the clerk, elections administrator, and prosecutor all had "dirty hands.")

More happened after that, but let's skip to the point of this email:

Volunteers from all over the county will be collecting signatures to recall Tyler for:

So far, residents from the following towns will join the petition drive:  Berrien Springs, Coloma, Stevensville, St. Joe, Buchanan, New Buffalo, Niles, Benton Harbor, and Benton Township.

1.  Allowing the Berrien County sheriff's department to remove the mayoral recall petitions from her office without a warrant, subpoena, or judge's order.

Judge rules for the People! Clerk files lawsuit AGAINST herself!


A Berrien County Judge ruled the Benton Harbor recall election can be held. This is a major victory for the people against fascist county and city governments, directed by the Whirlpool Corporation.

County elections administrator Carolyn Toliver removed more than 100 good petition signatures to attempt to prevent the mayoral recall election organized by Benton Harbor and Benton Township residents. 

What you're about to read is absolutely true.

County clerk Sharon Tyler filed a lawsuit against herself in order to prevent the recall election.  Whirlpool most likely directed her to take this action, probably a first in US election history.  Whirlpool was desperate because their man Hightower was losing by a large margin in the absentee ballots.         (Those were sent out before the powers-that-be called off the election.)

The Benton Harbor mayoral recall election will now be held on Nov. 4, 2014. 
The order was issued Tuesday, August 12 by Judge John Dewane after the Aug. 7  civil trial.

The decision to schedule the election hinged on Judge DeWane's decision that the practice of the Berrien County Clerk's office to disqualify both signatures, if a person signed a recall petition twice, violates First Amendment free speech rights.

This is a tremendous victory for people all around the country, with all the corruption not just in Benton Harbor.

Pinkney to bring criminal charges against Berrien County Elections Administrator and Deputy Sheriff

I will be filing criminal charges against Berrien County elections administrator Carolyn Toliver and sheriff deputy David Zizkovsky. 

Toliver removed more than one hundred good signatures to stop the mayoral recall election organized by Benton Harbor and Benton Township residents, including duplicates, dismissing both signatures. On the Berrien County website it states that when duplicate signatures occur, the latest signature with the latest date is invalid.

Toliver testified on Aug. 7, 2014 that deputy Zizkovsky had no warrant, no subpoena, no judicial order -- but she gave him the original mayoral recall petition anyway. 

The Law is clear:  All official books or records created by or received in any office or agency of the State of Michigan or it's political subdivision are declared to be public property, belonging to the people of the State of Michigan. No books, records, or files shall be removed from the office of the custodian thereof, except by order of the judge of any court of competent jurisdictions, or in response to a subpoena with permission of the official having custody of the records.

Michigan Court Law under 750.491 and Michigan Court Law under 750.492 have been violated.  Criminal charges will be filed on Wednesday, August 13.  It is a misdemeanor, punishable by imprisonment for not more than 2 years, or by a fine of not more than $1000.00 dollars.
Benton Harbor citizens' constitutional rights have been violated.

We need help from outside this county.

Benton Harbor is under surveillance and it's not an overstatement to say it's under occupation.  Occupying forces gradually instill a deep sense of fear in the inhabitants.  Over time, persistent fear wreaks havoc on peoples' relationships, way of life, peace of mind, etc.  

Proof of the occupation of Benton Harbor can be seen by driving through the town -- almost a ghost town.  Those who have not been imprisoned or driven out by the Whirlpool-owned courthouse rarely leave home.  The streets have been made unsafe by Whirlpool-owned law enforcement agencies.

Some of those who carry out the Whirlpool-directed corruption and Benton Harbor occupation are US Rep. Fred Upton, many Whirlpool officials, prosecutor Mike Sepic, sheriff Paul Bailey, deputy David Zizkovsky, county clerk Sharon Tyler, elections administrator Carolyn Toliver, and mayor James Hightower.

We need help from outside this county.

Whirlpool Wants Congress to Ban Class-Action Suits Tied to Energy Star Program:
After government testing showed that scores of consumer products carrying the Energy Star label did not deserve the listing, a wave of class-action lawsuits was filed against the companies that manufacture the products. A bill introduced by Representative Robert Latta, a Republican whose Ohio district is home to several Whirlpool factories, would prohibit class-action lawsuits if the E.P.A. came up with a remedy, like reimbursing consumers, for products that did not live up to their billing.  

Stop unmonitored, untested, irresponsible initiatives in energy followed by limits on liability.  
Have faith in the force of right and not in the right of force.
